Terms of Service
Last updated September 26, 2026
These terms are an agreement between you and Muscled Digital Agency (“MUSCLED”, “we”, “us”) covering the Viddy website, the Viddy desktop app and the Viddy API and MCP integration (together, “Viddy” or “the Service”). By signing in or using Viddy, you accept them. If you do not accept them, do not use Viddy.
Section 3 is the one most people skip and the one most likely to matter. Viddy can record a call, which means it can record other people's voices. Getting their consent is your responsibility, not ours.
1. Your account
You sign in with Google. You must be at least 16 years old, or the minimum age of digital consent where you live if that is higher. If you use Viddy for an employer or client, you confirm you have the authority to accept these terms on their behalf.
You are responsible for everything done through your account. Keep your Google account secure, since it is the only way into your Viddy account. Tell us at client@muscled.co if you think someone else has access to it.
2. What Viddy does
Viddy records your screen and, at your choice, your microphone, your system audio (what your Mac is playing, including the other side of a call) and your camera. It stores the recording, gives you a share link, and can transcribe the audio on your own computer.
Recording requires macOS permissions that only you can grant: Screen Recording, and Microphone or Camera if you use them. You control which inputs are on before each recording.
3. Recording other people is your responsibility
You are solely responsible for obtaining the consent of every person you record, before you record them.
Recording a screen captures whatever is on it. Recording system audio on a video call captures the voices of everyone on that call. Laws on recording conversations differ widely. Many places, including several US states and many countries outside the US, require the consent of all parties to a conversation before it can be recorded. Others require only one party's consent. Some also impose specific rules on recording in a workplace, on recording minors, or on recording conversations that contain health, financial or other sensitive information.
By using Viddy to record anyone other than yourself, you confirm that:
- You have told every person being recorded that they are being recorded, before the recording starts, and you have obtained whatever consent the law in each participant's location requires.
- You have the right to record and to share the screen contents, documents, chat windows and any other material that will be visible in the recording, including anything covered by confidentiality obligations or third-party rights.
- You will comply with all applicable wiretap, eavesdropping, privacy, data protection and employment laws, and with any recording policy of the organizations involved.
- You will honor a request from a recorded person to delete a recording of them, where the law gives them that right.
Viddy gives you the tools. It does not and cannot determine whether you have consent, and it does not give you legal advice about whether a particular recording is lawful. If you are not sure what the law requires where you and your participants are located, get advice before you record. We do not accept liability for recordings you make without the consent the law requires. See section 13.
4. Acceptable use
You agree not to use Viddy to:
- Record, store or share a conversation without the consent the applicable law requires, or record someone covertly where doing so is unlawful.
- Record or share content that is unlawful, that infringes someone's copyright, trademark, trade secret or other rights, or that you are contractually barred from disclosing.
- Record or share sexual content involving minors, non-consensual intimate imagery, or content that harasses, threatens, stalks or defames a specific person.
- Capture someone's credentials, payment details, government identifiers, medical records or other sensitive personal data without a lawful basis for doing so.
- Circumvent our access controls, attempt to read videos that are not shared with you, probe or attack the Service, or bypass playback authorization.
- Use the Service for bulk or automated storage or content delivery unrelated to normal recording and sharing, or resell Viddy storage or bandwidth as your own product.
- Misrepresent a recording as unedited or authentic when it has been altered in a way that is intended to deceive.
- Upload malware, or use Viddy to distribute it.
We do not review recordings as a matter of course. We may review a specific recording if it is reported to us, if we are legally required to, or if we are investigating abuse of the Service.
5. Your content and ownership
You own your recordings. You keep all rights you already have in the videos, transcripts and notes you create with Viddy. We claim no ownership of them and we do not license them to anyone else.
You grant us only the permission we need to actually run the Service: to store, encode, segment, copy for redundancy, and transmit your content to the people you have shared it with, and to display it to them on the share page. This permission exists so the product can function, it lasts only as long as you keep the content on Viddy, and it ends when you delete the content.
We do not use your recordings, your transcripts or your notes to train machine learning models, and we do not sell them or share them for advertising.
Notes other people leave on your videos belong to their authors. Your permission to keep displaying those notes alongside your video continues while the video exists on Viddy.
MUSCLED owns the Viddy software, the site, the brand and the marks. These terms do not give you any right to them beyond using the Service as intended.
7. Connected apps
You can authorize a third-party application, such as Claude or Cursor, to read your own videos, transcripts and notes through Viddy's MCP endpoint. These grants are read only, they cover only content on your own account, and you can revoke them at any time under Connected apps.
Once you authorize an app, what that app does with the content is between you and its vendor. We are not responsible for a third-party application's behavior, retention, security or availability, and its own terms and privacy policy govern it, not ours. Do not authorize an app you do not trust with your recordings.
8. Service availability and changes
Viddy is provided as it is available. We do not commit to any uptime figure, we do not offer a service level agreement, and we may take the Service down for maintenance, upgrades or emergency fixes.
We may add, change or remove features, and we may set or adjust limits on storage, recording length, file size or playback volume. If a change would remove something you depend on, we will give notice where we reasonably can.
Keep your own copies. Viddy is not a backup service. The desktop app can keep a local copy of each recording on your Mac, and we recommend you use it for anything you cannot afford to lose. We are not liable for lost or corrupted content.
9. Fees, plans and lifetime access
Viddy has a free plan and paid plans. The price, billing period and what each plan includes are stated on the pricing page at the time you buy, and that page is part of these terms. Nothing here obliges you to pay for something you did not agree to. Paid plans renew at the end of their period unless you cancel first; you can cancel at any time and keep the paid features until the period ends.
Limits that a plan states (hours of recording, recordings kept, storage, AI task lists per month, and similar) are part of the plan. “Unlimited” items are subject to the fair-use limit printed next to them on the pricing page, which exists to stop automated or commercial-scale use, not ordinary use by a person or a team.
A lifetime plan gives you the solo plan, with the limits stated when you bought it, for the life of that plan, and in any case for at least five years from the date of purchase. AI features are included as they exist on the date of purchase; features we add later may be offered separately. If Viddy is sold or transferred, your lifetime plan transfers with it unchanged (section 14). If the plan is discontinued, section 10 applies.
10. Suspension and termination
You can stop using Viddy at any time. You can delete your videos yourself, and you can request full account deletion by emailing client@muscled.co from the address on your account.
We may suspend or terminate your access if you breach these terms, if your use of the Service creates legal risk or unreasonable cost for us or for other users, or if we are required to by law. Where circumstances allow, we will tell you why and give you a chance to fix it first. For a clear or serious breach, including unlawful recording or content covered in section 4, we may act immediately.
If your account is terminated, your content may be deleted. Where we can reasonably do so, and where the reason for termination allows it, we will give you an opportunity to export your recordings first.
If we discontinue Viddy or a plan, we will give at least 90 days’ notice by email, keep your recordings viewable and give you a way to export your recordings, transcripts and task lists during that time, and refund the unexpired part of any prepaid period. For a lifetime plan, the refund covers the unexpired part of its five-year minimum term, pro rata, and nothing is owed once that term has passed. If Viddy is transferred to another company that continues the service (section 14), that is not a discontinuation.
Sections 5, 11, 12, 13 and 14 survive termination.
11. No warranty
Viddy is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
We do not warrant that a recording will succeed, that a transcript will be accurate, that audio or video will capture correctly on your hardware, or that content will always be retrievable. Transcription is produced by a speech recognition model running on your computer, and it will make mistakes. Do not rely on a transcript as a verbatim record without checking it against the audio.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
12. Limits on liability
To the maximum extent the law allows, MUSCLED is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill or lost or corrupted data, arising out of or relating to your use of Viddy, even if we were told such damages were possible.
To the maximum extent the law allows, our total liability for all claims relating to Viddy is limited to the greater of the amount you paid us for the Service in the twelve months before the claim arose, or one hundred US dollars (USD 100).
These limits do not apply to liability that cannot lawfully be excluded or limited, including, where applicable, liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation. Some jurisdictions do not allow some of these limits, so parts of this section may not apply to you.
13. Indemnity
You agree to defend, indemnify and hold harmless MUSCLED and its owners, employees and contractors from any claim, demand, loss, liability, fine, penalty or expense (including reasonable legal fees) arising from:
- A recording you made without the consent the applicable law required, or in breach of a privacy, wiretap, eavesdropping, data protection or employment law.
- Content you recorded, stored or shared through Viddy.
- Your breach of these terms or of any third party's rights.
14. Governing law, disputes and contact
These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of laws rules. Any dispute arising out of or relating to these terms or to Viddy will be brought exclusively in the courts of the Province of Ontario, Canada, and you and we each consent to that venue. If you are a consumer, this does not remove any right you have to bring a claim in the courts of your own country of residence where local law gives you that right.
If any provision of these terms is held unenforceable, the rest stays in force and the unenforceable provision is applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent. We may assign them, together with your account, your content and the rights of any plan you have paid for, in connection with a merger, acquisition or sale of assets; the assignee takes over those rights and obligations unchanged.
We may update these terms. When we do, we will change the date at the top of this page, and for material changes we will notify account holders by email. Continuing to use Viddy after a change means you accept the updated terms.
